The Transfer Process

This is the process of transferring the ownership of immovable property, and other real rights, from one person to another and can be broken down in a number of steps:

  • Open a new file
  • Request personal (FICA) documents from transferor and trustee
  • Deeds search
  • Request cancellation figures & deed, etc. from bank if applicable
  • Apply for clearance figures
  • Contact Purchaser's bond attorney for guarentees
  • Receive and Pay clearance figures
  • Receive cancellation figures and title deed
  • Prepare documents
  • Transferor signs documents
  • Transferee signs
  • Receive transfer duty & clearance certificate
  • Check all finances and guarentee receied from bond attorney
  • Cancellation attorney needs guarentee
  • Check all sale conditions have been met
  • Lodge documents ( +/- 10 days)
  • Documents on prop (1-4 days)
  • Register
  • Do final count
  • Pay Estate Agents commision etc.
  • Send title deed to bond attorney/ new owner
